Negative Constructive I stand to negate the resolution: Resolved: When in conflict, an individual’s right of self-determination ought to be valued above public health concerns . Before I begin the construction of my case, a few key terms must be defined. 1.) When in conflict – For simplicity and fairness, this phrase will be defined as one term. In order to ensure fair grounds for both sides, the definition for the round should be “when only one or the other can be maintained.” 2.) Self-determination- the freedom to make your own choices 3.) Ought – what should be done 4.) Public health - the health of people in general 5.) Concern - something that causes people to worry Considering these definitions and the core issues of the resolution, I affirm the resolution because doing so best achieves the value of life. Life is valuable for many reasons, most blatantly because it is the foundation of all other values. When compared to any other value, life is superior because without it that value could not be achieved. The value of life is fitting for the negative side of this resolution because of the author’s use of the words public health concerns which begs for this value. The criterion, which shall be used to determine and demonstrate why the resolution must be negated, is upholding the Social Contract. The foundation of all governments is the social contract between that government and the people. Basically stated, in order to live in the society the people of a government give up some of their rights so that the rest of those rights are protected. More specifically in terms of this resolution, the people in a society give up certain rights in order for the government to better protect their right to life. This is a fitting criterion for the resolution as it will clearly show the proper role of both the government and the citizens in a particular society, and, therefore will be the best way to determine if the resolution should be affirmed or negated. Contention 1: Medical isolation procedures keep infected individuals away from the rest of society, sometimes against the individuals will. The greatest good for the greatest amount of people should be a priority because a single person can endanger all of society. One of the ways in which we can prevent the spread of diseases is by isolating individuals who carry that disease even against the will of the individual. A great example is an outbreak of typhoid which was caused by Mary Mallon in New York City. Soon after she was discovered to by a carrier, Mary was forced to live in an isolated island against her will to insure the health of other people. Due to the fact that typhoid can only be transmitted through food or water she was allowed to return to society as long as she promised she would no longer
