601 F.2d 516 (1979) Dale Hackbart, v. Cincinnati Bengals, Inc., and Charles "Booby" Clark 10 circuit US court of Appeals, 1979 Procedural History: Dale Hackbart, the plaintiff brought suit against Cincinnati Bengals, Inc. and Charles Clark, the defendants in United States District Court for the District of Colorado for neck fracture sustained from alleged intentional tort during professional football gameplay between Denver Broncos and Cincinnati Bengals. Defendant testifies in court that out of “anger and frustration in the game”, he intentionally hit the Plaintiff in the back of the neck during gameplay but did not intend to harm him. Federal court judgment found by trial judges for the Defendants. The Plaintiff appealed to Federal appellate court, the United States Court of Appeals for the Tenth Circuit. Statement of Facts: During 1973 professional football game between Denver Broncos and Cincinnati Bengals, Dale Hackbart and Charles Clark were opposing players. During a gameplay engagement, Hackbart playing offense threw his body in front of Clark who was playing defense.
