Facts University at Texas Austin uses, race and other factors when determining admissions. The university uses critical mass as their plan of admissions. Abigail Fisher applied to the University of Texas and was rejected. She was a white female. She sued the university under the Equal Protection Clause of the 14th Amendment. In 2008, Texas had 29,501 applicants and just under 13000 were admitted. Texas enacted Top Ten Percent plan admitting the top 10% of high school graduates to any state college. Also, the university stopped using race specifically and used instead a Personal Achievement Index which also took into account personal factors. Once Grutter adopted a plan using race explicitly as a plus factor and considered among other factors so did the university,
