YOU'RE THE JUDGE 2 It seems that the defendant was speeding after seeing the police because he was aware of being in possession of illegal drugs. In this case, it does not matter whether the police were arresting him because of just over speeding but all what matters is that the defendant was in possession of illegal drugs. Therefore, the police had a good reason to arrest the defendant and that would not depend whether the computer check had an error that showed that the man had an outstanding misdemeanor warrant for arrest or not. Then, the alleged crime should be investigated by the police and after the police have investigated, they should initiate the criminal procedure through filing a complaint. As the judge in this case, before I decide on the best punishment to the offender, I would consider a number of factors. First, I would consider the degree of the offence if it was a mistake,
