Tommy and Danny would be guilty of class C felony because they planned to execute a robbery. Moreover, they are guilty of class C felony because they possessed a loaded firearm with the intent of using it unlawfully in their robbery. Therefore, the execution of Mike’s nephews’ robbery plan would make him culpable under class D felony. Mike’s intent is to ensure that his nephews accomplish their planned robbery without getting into too much trouble. For instance, he suggests to Tommy and Danny not to use a loaded gun because he knows that anything can go wrong with a loaded gun. Besides, he suggests to the boys that they should drive to their planned robbery location to survey the area and wear gloves.
