Hip.hop.world.tv@gmail.com - resumé - headshots/pictures in general The First Amendment: Congress shall make no law respecting an establishment of religion , or prohibiting the free exercise thereof; or abridging the freedom of speech , or of the press ; or the right of the people peaceably to assemble , and to petition the Government for a redress of grievances.” First Amendment Theory and Application - Applies to all government entities thru incorporation of Section 1 of the 14 th amendment: “…No State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any State deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws.” - Theories of the First amendment o Marketplace of ideas An environment where anyone can put forth his/her ideas Everyone’s idea has a shot of being accepted o Informed citizenry Related to the idea of democracy We as citizens make the decisions; we, then, have to be informed about the candidates and you will not have a viable democracy without informed citizens o “Safety valve” If you give people the opportunity to express themselves—gain support for their cause, especially if they don’t agree, they are not as likely to engage in any violent action About individual and their contributions to society as a whole o Necessary to individual growth and development Society benefits as we as a people grow individually and within groups - Functional tests (3 used within the 1 st amendment) o Absolutist When the 1 st amendment states “congress shall make no law,”
