That if the defense is able to provide the slightest bit of doubt that the defendant is not guilty or that their actions were justified to the court, they are given the benefit of the doubt and this could provide some innocence proclaimed. However, in some jurisdictions, the defense may be the onewho carries the burden of establishing facts that would provide evidence that the defense acted without premeditation, such as the insanity plea or self-defense. Moreover, the burden of proof isoften said to consist of two concepts: the burden of production and the burden of persuasion and there are plenty of legal standards that are required in with the burden of proof.
