Business Law August 31 Basis of Tort Law -Doing business today involves risks, both legal and financial -Tort- wrongful act, whether intentional or accidental, from which injury occurs to another. -its civil law - tortfeasor is the person who has interfered with someone’s rights -Tort Damages -monetary damages There are 3 elements to any tort: 1. The possessions of certain rights by an innocent party 2. A violation of those rights by the tortfeasor 3. A resulting injury that somehow hurts the person whose rights were violated Categories of torts: Intentional torts, unintentional torts (negligence), Strict liability. Intentional torts- requires that the defendant possess intent 2 categories- Intentional torts against persons and intentional torts against property Intentional torts against persons- assault battery false imprisonment, emotional distress, and privacy Intentional torts against property- trespass to land, trespass to personal property, and conversion Unintentional torts- negligence, reasonable person, most common type of tort.
