Business Law September 7 -Consent - If the plaintiff consents, the defendant will not be liable for that interference. -Exceeding Scope of consent (commits battery) -surgery -athletes -Self –defense - entitled to us reasonable force to prevent any threatened harmful or offensive bodily contact, and any threatened confinement or imprisonment - -Self-defense - Protection Only -No retaliation -Disarmed or helpless adversary -Verbal provocation -Harm must be imminent -Self-defense -Degree of Force -only degree of force necessary to prevent harm may be used -Deadly Force (if there is a threat of death, you can use deadly force) *** We can never use deadly force to defend property -Duty to retreat -“stand your ground” states -dwelling exception -Defense of Others -General Rule -may use reasonable force -Degree of force -Defense of Property -General Rule -may use reasonable force -Verbal demand is required first -Can NEVER use deadly force Negligence -UREASONABLE RISK -Tortfeasor does not intend????
