Lawyers and paralegals, who provide and charge for services that, by law, others cannot provide, commit to the public and their clients that they will act within the framework established by statute, by-laws and rules. -- David A. Cherif Rafik Ghobrial Paralegal Governance • Prior to regulation, many paralegals worked as non -lawyer agents • Agents could appear as advocates in: Small Claims Court Ontario Court of Justice Administrative tribunal hearings • Paralegal agents did not have to: Carry errors and omissions insurance Meet educational standards Follow code of ethics or professional responsibility • Some provided unauthorized legal services Immigration law, wills and estates, family law, real estate, etc. • This concerned the Law Society, provincial government, and consumer protection advocates • In 2004, Law Society of Upper Canada cr eated a Task Force on paralegal regulation • Task force made recommendations to legislature • The Law Society Act was amended on May 1, 2007 Authorized Law Society of Upper Canada to regulate paralegal profession Before Regulation Today No educational requirement Paralegal Education Program 120-hour practicum placement
