CHAPTER 5 Duty to the Administration of Justice Rule 6.01 The administration of justice is the courts, agencies, and people that comprise the legal system o Judges and justices, court staff, law enforcement agents, lawyers, paralegals, etc. A paralegal shall: o Encourage and improve public respect for the administration of justice o Avoid irresponsible allegations or comments, especially about judges or tribunal members May criticize the legal system, but must do so in a way that does not weaken or destroy public confidence Security of Court Facilities Rule 6.01(3) A paralegal shall inform court security if there is reason to believe a dangerous situation is likely to develop at court o This is a permitted ground for disclosure of confidential information o May warn other paralegals and lawyers the situation may affect Public Appearances and Statements Rule 6.01(4.1) Rule applies to press conferences, media interviews, electronic communications, etc. May only speak publicly about a client matter if it is in cl ient’s best interests and within the scope of the retainer Cannot share information that is substantially likely to harm someone’s right to a fair trial or hearing Decide on key points to communicate Disclose no more information than is necessary Be mindful of your duties: o Act with integrity and civility o Maintain confidentiality o Encourage respect for the administration of justice Working with Unauthorized Persons Rule 6.01(4.1) A paralegal shall help prevent the unauthorized practice of law or provision of legal services by not associating with unauthorized persons o An unauthorized person is a lawyer or paralegal who is disbarred, has surrendered licence or had licence suspended, or given an undertaking not to practice or provide legal services
