Case Name: Montalyo v. Radcliffe. 167 F. 3d 873 (4 th Cir. 1999) Summation of Facts: A boy by the name of Michael Montalvo was 12-years old whenever he was denied access in a martial arts class. The class was an offering of the school called U.S.A. Bushidokan. The particular class that Montalvo was interested in was one of combat-oriented martial arts originating in Japanese culture. Techniques involved in class consisted of full body contact, self-defense, and, in the nature of the sport, runs the risk of minor bloody altercations and injuries involving scratching, bloody noses and lips, and things of that nature as well as major ones. It was brought up that Montalvo tested as HIV-positive raising questions from the martial arts school. Montalvo falls under inclusion in the Americans with Disabilities Act.
