JLC MIDTERM REVIEW Crime : A socially constructed phenomenon that may not be inherently wrong o It violates law o Punishable by criminal sanction Types of Crime o Mala in Se : Acts that are evil within themselves (rape, homicide) o Mala Prohibita : Acts that wrong only because society says so (jaywalking, street curfew, prostitution) Crime v. Deviance o Crime is punishable by law o Deviance : Socially unfavorable behavior o Crime can be deviance but deviance cannot be crime Each subsystem has specific roles and responsibilities that complete the criminal justice system o Police : enforce the law, maintain order & provide protective services o Courts : determines innocence and punishments Prosecutors : represent the state in trials, has the discretion for charges, indictment and plea negotiation Judges oversee the court process i.e plea decisions, sentencing etc. o Corrections : supervise and counsel convicted, acts as a preventative for re entry Arraignment: 2 paths
