Summarizing and analyzing main points of the Draft on voluntary labor accident insurance (VLAI) Vietnam currently has no voluntary social insurance for occupational accidents. Therefore, to go in line with the social security policies stated in Article 34 1 and Article 59 2 of the Constitution of 2013 as well as Article 6 3 of the Law on occupational safety and hygiene, it is necessary to have provisions on voluntary labor accident insurance (VLAI) for workers who do not work under a labor contract. Currently, VLAI is covered only by commercial insurance in the form of health insurance. However, since this is commercial insurance for profitability, there are certain limitations in the implementation of the welfare regime for victims and their relatives (e.g., lack of long-term spending to compensate for the loss of income or support in life, the poor do not have enough money to participate in). For that mentioned reason, it is necessary to have provisions on the VLAI setting out standards to support those in a weaker position. In this topic, the author summarizes and analyzes some main points of the Draft 4 with the aim to help Vietnamese workers who are not under a labor contract have a quick look about their rights in the future. Labor accidents are "which cause injury to any body parts or functions or death of Employees, occurring during the labor process, are attached to the performance of work and labor tasks" 5 .
