Intentional Misrepresentation Making a statement knowing it to be false with the hope that the victim will rely upon it and is harmed as a result. Fraud The intentional deception of a person by another and made for monetary or personal gain. Malice Malice is a term that refers to a party's intention to do injury to another party. Civil Proceeding There are two sovereigns, the civil system and the criminal system. The civil system deals with the body of laws that sets out the rules and standards that courts follow when deciding civil lawsuits. Malicious Prosecution - Civil
