Title and Citation: Milkovich v. Lorain Journal (U.S. Supreme Court, 1991) 497 U.S. 1, 110 S. Ct. 2695, 111 L. Ed. 2d 1, 1990 U.S. Procedural History: This case originated in Franklin County, Ohio Court of Common Pleas. Then moved to Lake County Court of Common Pleas for the defamation ruling. Next it was sent to Ohio Supreme court and was dismissed, thus being sent to the Supreme Court of the United States where it was denied certiorari. Summary of Facts : Milkovich brought a suit against Lorain Journal Company, when it published and article, which implied that Milkovich had lied under oath in a judicial proceeding. Issues: Whether a newspaper can be held liable for defamation, when it published an article about a “public figure” which was designed as a character attack? Holding/Rule of Law: Held. Reversed. The court reversed the lower court ruling that the article constituted a constitutionally protected opinion, and held that while the First amendment does
