Kristin McCourtney BU341 Case 3 Lourcey v. Estate of Scarlet , 146 S.W.3d 487 (Sup. Ct., Tenn., 2004) Issue: Lourcey was delivering mail and encountered the Scarlett’s in the middle of the street. When Lourcey went to help, Charles Scarlett pulled a pistol and shot his wife then looked at Lourcey while he shot himself in the head. Lourcey sued the Scarlett estate claiming she suffers from depression and is unable to work due to the incident she witnessed. The Scarlett estate appealed the case. Rule: Mental Distress Application: Liability does not exist for every case of hurt feelings or bad manners, only where the conduct is
