Class 2 – Wednesday January 15, 2014 - People are constantly quoting precedents in regards to law - The fact that these decisions were ad hoc was important to how justice was practiced back then o Whoever you were appealing to had the wisdom and knowledge to create the proper decision o Oracle/Ordeal was left up to G-d Joshua 7 People would draw straws and whoever drew the short straw was chosen by G-d It was a random process that people believed was innate divine wisdom that G-d chose Scholars knew that the random process was only done infrequently because if it happened often people would be skeptical of it The fact that someone confessed had to do with the weight of something pointing to you – people confessed even if they didn’t do because they could hope for mercy and if you denied it you were denying G-d and it could only get worse for you o Physical evidence was left to the king (Joseph and Pharaoh’s wife) Genesis 39 If you wanted to get someone in trouble you could have a few pieces of evidence and then they would be convicted The woman had the power to send the man to prison only if she was very high standing in society This was a way to manipulate the judicial system o
