I. Assault A. Def - A person commits an assault when, without lawful authority, he engages in conduct which places another in reasonable apprehension of receiving a battery (Class C misdemeanor) B. Assault differs from battery (Many states now consider assault synonymous with battery) C. Simple assault (misdemeanor) D. Aggravated assault (Class A misdemeanor) E. Simple battery (Class A misdemeanor)

F. Aggravated battery (Class 3 felony) 1. Place - On public highway, amusement park, etc 2. Person - Teacher, mailman, police officer, etc G. Elements 1. Present ability to commit the act - (i.e. a person who throws a knife at someone out of range does not have the ability to hit their target) 2. Commission of an overt act - More than a threat.
