Cincinnati Bengals, Inc., 601 F. 2d 516 (1979)Procedural History While the Plaintiff, 35 year old Dale Hackbart professional football player and citizen of Colorado, who plays for National Football League team, the Denver Broncos, was in a game against the Defendant the Cincinnati Bengals Inc. also an NFL team, the Plaintiff was injured. The injury was due to an intentional struck by the Defendants’ player Charles “Booby” Clark. The Plaintiff, Hackbart and the Defendants’ player Clark proceeded to continue playing in the game despite the contact injury. However the Plaintiff later filed a lawsuit to recover for his injuries. The trial court found in favor of the Defendant, the 10thCircuit Court of Appeals reversed and remanded. Statement of FactsThe Plaintiff was injured by one of Defendant’s players in a professional football game.
