October 21, 2007 Midterm Review QUESTION FOUR o Explain the parts of presidential vs. parliamentary government o Then evaluate the parts through Posner and Rosen’s ideas o “Become the authors” QUESTION ONE o Posner Thinks separation of powers is important – explain is potential abuses and idea of separation of powers o Federalists What they say about separation of powers Say what abuses that they foresee o Compare and see if they are compatible Use a case study – ig. no: case of surveillance – Posner says this exhibits separation of powers and does not allow abuses; the federalists would say that this doesn’t allow separations, which allows abuses o If NO Posner is dependant of that of the Federalists – torture – thinks judges and the president should have more powers, such as torture and suspension of habeas corpus; the Federalists say that there should be stability and do not like change
