Midterm Study Questions ONE of these questions will be asked on the Midterm. The Midterm is Monday, October 22, 11:30-12:20 in Wilson Hall. Please arrive early with blue books to exchange. Bring two blue books if you think you may need more than one. Do not bring a knapsack or book bag unless absolute necessary. All such items must be left at the front of the auditorium. Cell phones are prohibited. You should have only an official blue book and a writing utensil when you are seated for the exam. I. In the conclusion to Not a Suicide Pact , Posner argues, “civil liberties reinforce the separation of powers by limiting the discretion of the executive branch. The separation of powers is an essential mechanism for correcting the errors to which each branch of government would be prone in the absence of a competitive environment.” However, Posner seems less concerned than the Federalists with the potential abuses of government power, abuses which the doctrine of the separation of powers was meant to check.
