I would recommend that Narayan should be charged with man slaughter and not murder. In these circumstances the anger of Narayan has built up over many years which has led her to the poor actions she has committed. She has been the victim of much physical violence and mental strain from her husband over these years and it was therefore expected that she would be angered and feel the need to do something violent. Due to part (a) of Section 10 of the Sentencing Act which states the circumstances of the offence must be taken into account I believe man slaughter and not murder is an appropriate outcome. These circumstances are as mentioned above and that she was not intending to kill him. This means that she accidentally killed him and it is therefore not murder as there was no pre thought to kill her husband. Although there was a pre thought to burn his penis, I believe this is completely different to wanting to kill him.
