FACULTY OF ENGINEERING & QUANTITY SURVEYING (FEQS) BSc (Hons) in Quantity Surveying 1.0 Introduction In this assignment, most of the question is related to the clauses of the Contract under PAM of Contract, 2006 with Quantities. So that, we must refer to the conditions of PAM Contract before starting this assignment. In Task 1, the Schedule of Defects under PAM of Contract, 2006 with Quantities have been discussed. The contractor dissatisfied with the list clamming that most of it was not due to his fault. The classification, clauses that can be applied to the case, obligation of both parties in solving this issue, remedies to the client in the case of dispute over the issue persistent and rejections by the contractor will be covered in this task. In Task 2, we will discuss about the general rules for issuing and complying with the Architect’s Instruction (AI). Architect must give the correct AI relevant to clauses of PAM Contract for the removal of works not done according to the Contract requirements, exclusion of persons from the site, making good defects and compliance with Local Authority in the by-laws and regulations. In Task 3, a scenario is provided a mixed development project had been highlighted in a site coordination meeting that client expect the project to have zero variation. We are appointed by them as the quantity surveyor to lead the team by ensuring that there will be no variation from pre to post contract. We will manage the situation by cost controlling and knowing the contract as well during the Pre-Contract stage, choosing a good consultant, and designing management and hiring the faithful contractor. In Task 4, we will discover the issuance of the Letter of Acceptance under the PAM of Contract. Besides, we will list down the duties and obligations on client and the contractor to the contract before and after commencement date of the work on site up to the completion stage and also the cite down the completed project which are relevant to this task. 1

FACULTY OF ENGINEERING & QUANTITY SURVEYING (FEQS) BSc (Hons) in Quantity Surveying 2.0 Introduction to defects Construction Defects can be defined as a defect of the design, the workmanship or even the materials and system used on a project that results in a failure of a component part of a building or structure. It may also cause damages to person or property, and usually resulting in the financial harm to the owner. However, Construction defects are one of the most common causes of disputes and litigation in the construction industry, where there is often disagreement when it comes to identify what a construction defect. In clause 15.4 in PAM Form of Contract, any defects in the works which appear within the Defects Liability Period shall be specified by the Architect in a schedule of defects which he shall deliver to the contractor not later than fourteen days after the expiration of the Defects Liability Period. The contractor shall make good the defects specified within twenty-eight days after receipt of the schedule of defects at the contractor’s cost.
