ORAL AND WRITTEN CONTRACTS2The Buyers vs. Stan SalesmanThe requirements for a valid contract in either oral or written are both the same and easyto abide by. When the requirements are not met that’s where a lawsuit happens. Written contractsare far superior to an oral contract, which Jim and Laura Buyer will soon find out.BackgroundJim and Laura Buyer are fighting to get their one hundred dollars back from a cardealership. Stan Salesman helps the Buyers look for a car that would suit them. After testdriving, several cars they selected a blue sedan. Stan tells them that to hold the vehicle fortwenty-four hours, they would need to pay a one hundred dollar deposit, which he says iscompletely refundable. The Buyer’s did not sign any documents and received no receipt. Thenext day the Buyer’s choose not to purchase the car and request their one hundred dollars back.Stan then tells them that the money was intended to be part of the contract to buy the blue sedanand the one hundred dollars goes towards the purchase of the car. Stan insists that Jim and Laurahave agreed to buy this car. Jim and Laura are livid because they did not want to spend theirmoney this way and feel cheated and seek advice from a lawyer.
