CLAIMS OF NEGLIGENCE 2 After reviewing the case, the best chance of a successful claim for negligence would come from the scenario if death was a result of overdose. He refused the blood transfusion so there is not a way to blame his death on that, at fault of the doctors. Subdural hematomas are usually caused by head trauma, which could’ve been a result of an automobile accident but may have shown signs when arriving at the hospital such as headache, slurred speech, nausea, or dizziness, just to name a few. If this man was an addict, there is a strong possibility that he could function normally on the drugs and alcohol and able to answer questions but when the doctor administered morphine, it could have caused the man to overdose. When the man was brought into the emergency department, they should have run a drug screen or blood work prior to administering any other medications. Even if they didn’t do the
