3. Mike and Tony decided to spend their Friday night at a downtown sports bar. After several rounds of cheap appetizers and alcoholic drinks, they joke and talk trash to each other. Later, however, Mike vomits on the floor. His speech slurs and he has trouble staying still. Tony notices this and thinks that it is the perfect time to convince Mike to sell him his 197mph open-top Audi R8 Spyder. Tony writes his price on Mike’s hand, and surprisingly, Mike agrees to sell him the car, yelling, “It is a deal! For $200,000, you can have my sweet baby!” The two shake hands and make plans to seal the deal. The next day, Tony arrives to Mike’s home with his check, but Mike refuses. Is this contract enforceable?
Tony knew that Mike had several drinks. He also witnessed Mike struggle with speech and basic movements. It was clear that Mike was inebriated.
