Yan Ju Wang v. George Valverde California Court of Appeals 162 Cal. App. 4 th  616 (2008) Facts:   Yan Ju Wang (plaintiff) had a valid class C driver’s license and applied for class B  driver’s license.  Wang was not allowed to complete the exam required for class B license due to being  allegedly caught cheating using crib notes.  Criminal action/charges were not brought on Wang, however, the Department of Motor  Vehicles (DMV) did revoke class C driver’s license.  Wang utilized and exhausted all administrative processes to get revocation of class C  license removed. Wang sought writ of administrative mandate to set aside revocation of  class C driver’s license.  Trial court granted Wang’s petition for writ of administrative mandate compelling the  (DMV) to set aside its revocation of plaintiff’s call C driver’s license.  DMV appealed, arguing that they had caught plaintiff cheating on examination for class  B driver’s license and had the authority to revoke based on Vehicle Code, §13359.  o DMV may refuse to issue a license to any person who commits fraud in any  application.  Issue(s): Judgement affirmed. Respondent shall recover her costs of appeal.  Can the DMV, as a matter of law, revoke a class C driver’s license, based off allegation  that she was cheating on class B license examination.  Reasons:
