Landlord-Tenant Contract Landlord-tenant law has three primary facets which are property, negligence, and contract. A lease is a contract that creates the tenant – landlord relationship between the two because the property owner (landlord) is allowing an individual temporary ownership of the property. Negligence of law is used in landlord-tenant disputes to determine liability for cases of personal injury or damages/loss to personal property. The contract/ lease agreement will clearly state both parties’ names, the address The Statue of Frauds requires the tenant -landlord contract to specifically states and clearly labeled how the tenant may use the premises, who is liable for damages, who must maintain and repair the property and more. It is the landlord’s duty to make sure the property is in a habitable condition at all times, and meets legal standard. All rental property must comply with Building Codes, whether stated in the contract or not. The Implied Warranty of Habitability considers the significance of the issue and their time span. Lastly, a Landlord is obligated to either return the security deposit or inform the tenant of the damages and the cost to repair them. Negligence law will establish the liability of Larry the landlord and Roger, the tenant with their dispute of the leak and damages from the baseball bat. Both the landlord and tenant have rights and responsibilities in a rental contract. Both parties are protected under the legal right, which discloses the disposition of the relationship between the landlord and rental party. The landlord has a legal and ethical responsibilities to their property and is responsible for repairs to the apartment. The landlord has the responsibility to provide a secure place for the tenant to reside and the tenant should feel safe inside and outside of the apartment. This means doors and windows should have the proper working locks and a dead bolt on the front door with only the landlord and tenant having a key. The apartment should be in a quiet and clean environment.
