Case Name- Hackbartv. Cincinnati Bengals, Inc, Citation- 601 F 2d 516 (10thCir.1979)Facts- During a 1973 professional football game between the Denver Broncos and Cincinatti Bengals, Dale Hackbart and Charles Clark were opposing players. During a game play engagement Hackbart playing defenses threw his body in front of Clarks who was playing defenses. While Hackbart was on the ground Clark approached behind him from behind and stuck his forearm below to the back of the head. No officials saw this, and the players continued playing the game. Not until a few weeks later that Hackbart filed a claim and by agreement of both parties the case was to be heard without a jury solely for the determination of the issue of possible liability between professional football players. Procedural History- The plaintiff Dale Hackbart sued defendants, The Cincinnati Bengals INC and Charles Clark. The suit was filed in in the United States District Court for the District of Colorado for a neck
