The Texas Constitution The Texas Constitution took effect on February 15, 1876. Like all Confederate states, Texas had to redo its constitution after the Civil War… The Texas Constitution has 17 articles laying out the rules for governance in the state. Some provisions in the articles likely violate the U.S. Constitution, such as requiring state officials to believe in a “Supreme Being,” but have never been challenged in court. Between 1876 and 2015, the constitution has been amended 491 times. This is because, unlike the U.S. Constitution, the Texas constitution must grant specific powers to the state. Texas cannot broadly interpret its constitution the way the federal government can broadly interpret the U.S. Constitution.

Evolution of the Texas Constitution: Early Years In 1881, the Texas constitution created the legal infrastructure needed for the University of Texas, which opened two years later. In 1883, school districts were empowered to levy their own taxes, and the state increased funding for public schools. In the 1890s, the Texas constitution was amended to create more elected positions among statewide office-holders, rather than appointed positions. In 1912, the “Home Rule” amendment allowed municipalities of over 5,000 people to be subject only to the Texas constitution and general laws, giving city governments tremendous discretion. In 1917, the Texas Railroad Commission was given control over pipelines, and in 1919 over the production of oil and natural gas (making it the huge political player it is today!). The 1930s and 1940s saw the creation of welfare agencies for the first time. In 1942, the “Pay As You Go” amendment required a balanced state budget. In 1949 and 1951, additional amendments modernized the state budgeting process. In 1947, Texas started to guarantee a quality public education program for all with the Minimum Foundation School Program.

Evolution of the Texas Constitution: Later Years In 1961, the state sales tax was adopted. In 1972, the Texas Equal Rights Amendment was passed and banned discrimination against women in arenas like employment and lending. The Texas Commission on Human Rights was instituted in 1983. In 1974, all high elected offices in Texas were standardized at 4-year terms and term limits were removed. In the 1990s, the state comptroller began, at legislature request, to operate “performance reviews” of state agencies to improve efficiency.
