Leoff v. S&J Land Co. U.S. Court of Appeals for the 10 th  Circuit 2012 U.S. App. Lexis 24560 (2012) Facts:   Richard Leoff (plaintiff) sued S&J Land Co. (defendant) after a condominium business  deal fell through. Leoff placed a lien on the condominium and sought damages and  enforcement on the lien.  S&J Land Co. argued that a partnership was established with Leoff and under Colorado  law liens cannot be placed on partnership property.  After court ruled in favor of S&J Land Co., Leoff had a chance to submit an amended  complaint. Leoff then submitted complaint that S&J Land Co. defrauded him. Motion  denied and deferred until trial. Trial resulted in the court ruling that the partnership was established however, the  partnership disassociated with S&J Land Co. actions making the partnership not
