NABOISHO NAROK – KAJIADO AGREEMENT THIS AGREEMENT is made this day of Two Thousand and Eighteen BETWEEN NAROK COUNTY GOVERNMENT of Post Office Box Number 898 - 20500, Narok in the Republic of Kenya AND KAJIADO COUNTY GOVERNMENT of Post Office Box Number 664 - 01100, Kajiado in the Republic of Kenya ( Hereinafter refer to as the parties) which includes their successors in title and assigns on the other part. WHEREAS on the 27th of August 2010, the new Constitution of Kenya was promulgated effectively introducing the devolved systems of government into the country; AND WHEREAS the Constitution recognises that the governments at the national and county levels are distinct and interdependent and shall conduct their mutual relations on the basis of consultation and cooperation; AND WHEREAS the Constitution envisages governments at all levels to liaise for the purpose of exchanging information, coordinating policies and administration and enhancing capacity; AND WHEREAS the Constitution recognises the need for Government at each level, and different governments at the county level, shall co-operate in the performance of functions and exercise of powers and, for that purpose, may set up joint committees and joint authorities; AND WHEREAS the County Governments Act gives effect to Chapter Eleven of the Constitution by providing for county governments' powers, functions and responsibilities to deliver services; AND WHEREAS pursuant to section 6 (2) (a) of the County Governments Act, the County Governments may enter into agreements; AND WHEREAS a critical object of the system of devolved government, according to Article 174(f) of the Constitution of Kenya is to promote social and economic development and provide proximate and easily accessible services across Kenya: AND WHEREAS the Constitution of Kenya provides an enabling framework for establishment of regional economic Blocs, and in particular, Article 189(2) of the Constitution require County governments to cooperate in the performance of functions and exercise of powers and permits the establishment of joint committees and joint authorities to facilitate such cooperation: Page 1 of 23

AND WHEREAS the Intergovernmental Relations Act, Chapter 5G of the Laws of Kenya, establishes a framework for consultation and cooperation between the national and county governments and amongst county governments; AND WHEREAS the Counties of Narok and Kajiado have enjoyed close historical, political, cultural, commercial, industrial and other ties for many years; AND WHEREAS the said counties have been continuously marginalised since independence; AND WHEREAS there has been conflicts between counties over resources, security and political organization within the said counties; AND WHEREAS the leadership voices of the said counties have been pulling in different directions; AND WHEREAS there has been unhealthy competition within the leadership of the said counties;
