However, according to the doctrine ofpromissory estoppel the execution of the agreement even lacks the existence of a valid review. This ismeant to protect the promisee in case the promisor denied the responsibility of the view and allegesthat the promise was not enforced lawfully.A contract is legal when the parties intend to create a legal relationship. Mostly, when aconsideration of the parties is conducted will be evidence to prove intention, but not always. Inspecific cases, the court will require proof of onus to conduct the investigation. Often, commercialtransactions will be considered legal consequences while social commitments are not.In the case there is a social and domestic relationship, which meaning the relationship betweenfriend or family, it will be considered as no intention of binding a legal contract. ApplicationBased on below points, there is no legal contract between Alan and any other parties. However, Alandid not provide exactly goods as he offered to Bernard and Damien. Besides, due to the fact that thematerial was issued free of charge by Kaplan, it is considered as Alan had a misrepresentation tomake Bernard and Damien to buy the book. This fact allow Bernard and Damien had a legal rightrevoke the contract and ask for a refund from Alan.
