Topic involves a critique of rape myths with respect toR. v. Ewanchuk (1999)TOPIC “Many feminists have explored the operation of rape myths in Canadian law and in Canadian society as a whole. These myths can be linked to the social construction of gender, race, class, masculinity, femininity and heterosexuality. The Supreme Court of Canada’s decision in R. v. Ewanchuk (1999) tends to be regarded as a feminist victory. The Court ruled that a defence of “implied consent” cannot be used for the offence of sexual assault, or in other words, “no means no.” Moreover, the Court called attention to the problematic nature of many rape myths.
