Running head: GOOD SAMARITAN HOME 1 Good Samaritan Home Name College Good Samaritan Home Civil law is concerned with wrongs between individuals’ rights arising out of a contract whereas criminal law is about punishing offenders for crimes committed (Bouvier, 1897). The incident at the “Good Samaritan Home” can be tried under both laws. Under civil law, the violation of rights was committed to individuals, since “the nursing aides verbally and physically abused the patients…” (Star Tribune, 2011). The institution is liable for negligence since it failed to protect the patients against their employees, exposing them to harm. As a criminal offence the aides had, among other offences, assaulted and abused vulnerable adults with sexual contact (Star Tribune, 2011). The nursing aides committed both assault and battery. They assaulted the patients with verbal abuses, intentionally causing them the apprehension of harm. Battery was also elicited as they physically injured the patients with their conduct.
