January 14, 2018Anna CherkashinaAcct 261-01IRAC analysis on:Maria v. HayesIssuesThere are many issues within this case one of them is weather the court has the power to decide that Edith Melissa Maria Hayes can get sterilization or not. Another issue is if Edith’s’ parents have a say in the decision whether she gets sterilized also, will sterilization affect the rights of privacy for Edith.RulesJurisdiction is the official power to make legal decisions and judgments. The court has to have a jurisdiction in order to decide if Edith Hayes can get a sterilization or not. Also, the right to privacy is a constitutional law and Edith has that right so, sterilization can interfere with that.AnalysisThe Superior Court has the jurisdiction to approve or deny any sterilization for a mentally incompetent person. Washington Constitutions grants this power under article 4&6. This is very important decision for the court because if Edith does get pregnant at age 16 not only will it affect her but her parents or guardians, because she is not capable of taking care of that child
