Branzburg v. Hayes The first case occurred in November 15, 1969, The Courier-Journal carried a story under Branzburg’s by-line describing in detail observations of two young residents of Jefferson County synthesizing hashish marijuana. Branzburg refused among the grand jury to identify the individuals he had seen possessing marijuana or the persons he had seen making hashish from marijuana. A state trial court judge ordered Branzburg to Answer these questions and rejected his convention that the Kentucky reporter’s privilege statute.. the First Amendment of the United States constitution or the Kentucky constitution authorized his refusal to answer. The second case involved a case where Branzburg deceived in detail the use of drugs in Frankfort, Kentucky.
