Response: No, the ADA should not become age-based to benefit only specific groups within a certain age. The purpose of the law is to provide equal opportunity to those who have disabilities. If it were age- based this would technically mean, people can discriminate up to a certain point, in this case -- age. If I were to look at any possible pro, my guess would be funding? Cons would be that it would be okay to discriminate to a certain point, which is not okay. b. Based on your observations - Does the ADA protect the rights of older adults without disabilities? With regards to the ADA, you would have to qualify by having a physical or mental impairment that limits you substantially, a record of this impairment, or regarded as having an impairment (Illinoislegalaid.org, 2017. Old age is not a disability.
