Assignment 2: Landlord-Tenant Law Landlord- Tenant Law Landlord and Tenant both have rights and the Landlord-Tenant law details the rights of both parties. This law protects one from wrongdoing by the opposite party. Landlord-Tenant Law is comprised of three areas, property, contract and negligence [Bea16]. It is important for Both Landlord and tenant to follow these laws as disobeying these laws could result in a lawsuit. A landlord-tenant relationship is created once the landlord or owner allows a person temporary exclusive possession of their property [Bea16]. On assignment as a mediator, I will look at the situation between Larry landlord and Roger Renter and consider if the legal area negligence comes in to play. Negligence law determines the liability of landlord and tenant where there is personal injury or damage to property. Real property like land, fixtures and buildings are covered under the landlord-tenant law. The area of contract is in place because there is a valid contract between Larry Landlord and Roger Renter. Larry had a renovated apartment that he wanted to put on the market. He was looking for the ideal tenant to rent the apartment to. Roger saw the for-rent sign and inquired about the rental property. Roger loved the apartment and noticed inside of the home was newly updated, he also noticed the outside of the building was a bit old but had fresh paint on it. Because of the look on the outside of the building Roger asked Larry if the apartment had any leaks due to rainfall in the summer months, Roger knew summertime brought lots of rain. Larry said he was unaware of any leaks. Roger didn’t think anything of it and in October signed the lease to move in the apartment

The following June a rainstorm came, and Roger noticed there was a leak in the roof of the apartment. Roger didn’t think anything of it and put a trashcan under it, he did mention it
