G.R. No. 188320, June 29, 2010 People of the Philippines v. Honorio Tibon FACTS: Honorio Tibon (Tibon) and his common-law wife Gina Sumingit (Gina) lived together as husband and wife and had two children, Keen Gist (KenKen) and Reguel Albert (Reguel). Due to financial difficulties, Gina went to Hong Kong to work as a domestic helper, leaving Tibon with custody of their two children. After some time, Tibon heard from his sister who was also working in Hong Kong that Gina was having an affair with another man. After the revelation, he was spotted drinking a lot and was seen hitting his two children. On the night of December 12, 1998, Tibon’s mother and his siblings, went to his room and saw him with KenKen and Reguel. The two children were lying on the floor with wounds on their bodies and appeared to be lifeless. After realizing that his mother and siblings had seen his two children he stabbed himself on the chest with a kitchen knife, jumped out the window of their house.
