BORACAY Foundation Inc. vs Province of Aklan GR No. 196870, June 26, 2012 The report of the Boracay 2010 Summit showed that there was a need to expand the port facilities at Caticlan due to congestion in the holding area of the Jetty Port and Passenger Terminal, hence Respondent Province conceptualized the expansion of the port facilities at Barangay Caticlan. The Sangguniang Panlalawigan authorized the Governor to enter into negotiations for the renovation and rehabilitation of the existing facilities and reclamation of 2.64 hectares of Caticlan foreshore for commercial purposes despite the strong oppositions manifested by the Barangay Caticlan and Municipality of Malay contending that the reclamation project was for business enterprise purposes for the province’s benefit, at the expense of the local government of Malay and Brgy. Caticlan, which by statutory provisions was the rightful entity to develop, utilize and reap benefits from the natural resources found within its jurisdiction. A feasibility study was conducted and the Environmental Performance Report and Monitoring Program (EPRMP) was attached and they were able to secure an Environmental Compliance Certificate. The province deliberated on a possible expansion of the proposed reclamation area of 2.64 hectares to 40 hectares to maximize the utilization of its resources and took notice of the vulnerability of the
