News Paper Article for: The Girl Scouts Have Sued the Boy Scouts. Now What!! By Deena Kuehm The parties who are present in this article are the Girl Scouts of America, and the Boy Scouts of America. The primary lawsuit which is taking place is with the Girl Scouts (Plaintiff) who are suing the Boy scouts (Defendant) due to fears of their trade name being damaged. The type of Tort that is best used in describing this type of case is Slander of Title. A Slander of Title is “If a defendant falsely disparages the property right of another.” J. Stanley Edwards, J.D., Tort Law 13-6b (6th ed. 2015). After leaking earlier this year the “Boy” in Boy Scouts would be dropped from their name, the President of the Girl Scouts wrote a trenchant letter to the President of the Boy Scouts accusing them of secretly recruiting girls into their organization. The Girl Scouts are accusing the Boy scouts of trade name infringement, confusion of the public, and partaking in an unfair competition for a more appealing organization.
