Business Law 2 1. Is Fran bound by the written agreement with Marco? (5 marks) Fran as a business owner needed an assistant and entered into a contract with his brother Marcos. The agreement formulated by the lawyer highlighted the set working hours, the rate of pay, reimbursement for fuel and maintenance costs, responsibility for vehicle insurance and various other details. Fran and Marco signed the agreement after going through it, but Fran decided to hire another person instead. An employment agreement which is a form of contract should be adhered to, and the contractors are said to be in the contractual relationship once both parties have signed the agreement. In the above case, when Fran and Marco read through the employment agreement and append their signatures, the contact took place, and both parties are to be held liable should they go contrary to the directions of the contract 1 . On the signing of the employment agreement, Fran is expected to honor all the requirements for the employee, and Marcos is also likely to do as per the contract until they end their contract. The decision made by Fran two days later after realizing that the contract was not of her liking to hire another employee is, therefore, illegal; and the contract they signed earlier with Marcos binds her. Hiring another worker two days after getting into an agreement with Marcos is a violation of the contract that was already signed, and Marcos is protected under the contractual law to be paid the fine for the act 2 . The moment Fran signed the contract meant that she was satisfied by the terms of the contract and she was liable for breaking the contract. The regrets that came later and made her hire another worker cannot protect her from the fact she broke the contractual law because she signed the contract and her signature is evident. Business Law 3 bounded by the employment agreement and the fact that she hired another employee means that she can be sued and found guilty by law 3 . Marcos can decide whether to seek justice for the waste of time and the sacrifice he had made because he sacrificed a well-paying job in the city for his sister.
