02.01 The First Amendment Supreme Court Case Analysis Use this chart to make notes about landmark Supreme Court cases. Be sure to include significant terms and quotes from the case opinion. Case: Tinker v. Des Moines Independent Community School District (1969) SYLLABUS What are the facts? What is the background? What law, amendment, and/or constitutional text is in dispute? Don’t forget to include relevant rulings, legislation, and events. The background of this case is a public school in Des Moines, Iowa suspended three students who were wearing black armbands in protest of the Vietnam War. The students were planning to wear black armbands at school to protest this war, but the principal found out and decided to suspend the students if they wore armbands. Even though they were warned, the students deiced to wear the armbands, and got suspended. While on suspension the parents sued on grounds of free speech violation. A US district court ruled in favor of the school that the armbands could disrupt the learning process. So the students then appealed the ruling on the US Court of Appeals, but once again lost, so they took their case to the Supreme Court (SCOUTS). This is a dispute of their first amendment rights. MAIN OPINION What was the decision? What was the majority opinion? Who wrote it? What were the key points? What reasoning was used to justify the opinion?
