Deeds THE CLOSING A. Three Types-(1) general warranty deed, (2) special warranty deed, (3) quitclaim deed (Mr. Deed says “I’ve got to be LEAD” Lawfully Executed And Delivered) B. Lawful Execution : in writing, signed by the grantor C. Properly Delivered : can occur when the grantor transfers the deed to the grantee. a. Delivery doesn’t necessarily require actual, physical transfer of the deed, itself. b. Delivery is a legal standard, not a literal standard c. Delivery means grantor has shown the present intent to be immediately bound, regardless of whether or not the deed itself was literally handed over. Three (3) members of the Deed family: d. General Warranty Deed: warrants title against all defects in title, before or after grantor took title; the best deed a buyer can hope for. Promise made on behalf of all grantors predecessors. (See G. Express Warranties) e. Statutory Special Warranty Deed: warrants only against the grantor’s own acts but not the acts of others; a creature of statute; contains 2 promises that grantor makes only on behalf of himself i. Grantor promises he hasn’t conveyed property to anyone other than grantee ii. Property is free from encumbrances made by grantor f. Quitclaim Deed: no warranties of any kind; grantor isn’t even promising he has good title; this is the worst deed you can get. Shaggy’s song: Wasn’t me.
