SPECIAL ISSUES IN CRIMINAL JUSTICE 2 Special Issues in Criminal Justice A national study of the conditions of confinement in juvenile detention facilities by the OJJDP found that “there are serval areas in which problems in juvenile facilities are substantial and widespread-most notably living space, health care, security and control of suicidal behavior (Schmalleger,2017, p.520). Also, the major issues in the criminal juvenile justice system is that they accept petitions of delinquency rather than criminal complaints, conduct hearings rather than trials, adjudicate juveniles to be delinquent rather than find them guilty of a crime and order one of a number of available dispositions rather than sentences (Schmalleger,2017, p.2019). Another problem facing the juvenile justice system as defined in Harris County Mental Health Court is “through the prevalence of mental disorders among youth in general populations is estimate to be about 22 percent, the prevalence rate for youth in the juvenile justice system is estimate to be as high as 60 percent. Due to lack of appropriate and accessible community behavioral health services, frustrated families frequently resort to the juvenile justice system as they struggle to manage their child’s escalating emotional difficulties (2006). The question arises if teens should be treated like adults? I n an article from Teen Ink Georgetown University “TEENS SHOULD ABSOLUTELY BE TRIED AS ADULTS WHEN THEY COMMIT ADULT CRIMES” goes on to say “When it comes to trying teens in court as adults. Some say stop trying them as adults and try them as juveniles”( January 11,2010). I
