LAW 2 A. What would the truck driver need to establish to show that Bob is directly liable for negligence for failing to supervise Jake adequately? About the remedies available, you should discuss the ‘heads’ or types of damages that could be claimed. For the plaintiff, in this case, the driver to win a negligence lawsuit against Bob, he must be able to prove all of the negligence elements. For example the damages, the driver should be able to prove the loss and injuries he has faced such as the loss of his job as well as the head injuries and the broken leg. The harm caused due to the negligence is significant since even if someone can prove the negligence of the defendant, he might not be successful in the lawsuit if the negligence caused him or her no harm. For the truck driver to neglect, he must demonstrate that the responsible party, Big Bob's Discount Tyres had a duty, they happened to breach the duty, the breach of the duty led to the accident, and there were damages in the accident ( Owen, 2006). A truck driver on his side has a duty of following the rules of the road such as the federal and state regulations governing trucking. The tire center also has the duty of ensuring the tires are adequately fixed and safely ( Stapleton, 2011 ). When making decisions on a verdict in a case of negligence, the judges are instructed to compare, evidence, testimonies, and facts in finding out whether the elements such as duty, breach of duty, cause, in fact, proximate cause and damage is satisfied ( Kelley, 2009). These are the elements which the driver needs to prove to win the case of negligence against Bob. Looking into duty, this arises when the law proves the plaintiff/defendant relationship requiring the defendant to act in a specific way to the plaintiff ( Grady, 2012 ).
