CHAPTER 2 Chapter 29 Murder refers to the act of taking away the life of a person intentionally after establishing a plan for killing ( Smith & Keenan, 2004). Murder, also referred to as malice aforethought would only take place when a person had the intention of harming. For example, an individual can deliberately and premeditatedly kill another person in the course of a felony like a burglary or kill using explosives. Such a case would be termed as murder. On the other hand, manslaughter refers to unjust taking away of an individual’s life, but without forethought ( Smith & Keenan, 2004). For example, accidentally stabbing somebody in a bar fight or forgetting to remove a child from a hot vehicle.
