January 28 th , 2008 Government and Politics The Articles of Confederation (AOC) Reasons why a new constitution was necessary o 1.  Structural weakness of the AOC No real executive. Scared of an American king so they did not  establish a real executive. Very little real power. Part-time unicameral legislative. No real full-time legislature like we have today. People don’t focus all their energy on a part-time. They put their primary occupations ahead of their  legislative positions. No Independent Judiciary. No Supreme Court. The judiciary functions were done by the  legislature. o 2.  Lack of Critical Papers *** No power to tax .*** You need to tax to get money. No power of raise national army or navy. Every state had its own but did not have one army.  We had conflict amongst the leaders and  commanders of each state. No power to regulate interstate commerce.
